At oral arguments in SEC v. Coinbase, Judge Failla expressed concern that the SEC’s view of what constitutes an investment contract security sweeps too broadly, but appeared cautious about applying the Major Questions Doctrine to preclude the SEC’s claims. In Congress, Senators Lummis and Hagerty introduced legislation that would create a pilot program for federal agencies and crypto firms to share information to detect and combat illicit finance activity.
